NATCHEZ — A hearing scheduled for Tuesday that would have determined whether or not land formerly owned by West Enterprises, could be sold in bankruptcy never happened.

West’s president is former Natchez Aldermen Theodore “Bubber” West.

Attorney John Underwood, who represents Apex Mortgage, which now owns the property, said Tuesday’s hearing was postponed because no court reporters were available.

Since May 29, when several parcels of land owned by West Enterprises were sold in foreclosure, West has maintained the land could not be sold because of a bankruptcy filing made the day before.

“Now we just have to wait and see,” Underwood said.

Underwood said he believes a previous bankruptcy court opinion made in 2008 on a previous West filing, which would allow the sale of the property, still applies to the most current filing.

Tuesday’s hearing was rescheduled for July 29.

Additionally, Underwood said he is still in communication with West family Attorney Halbert Dockins to discuss family members that are interested in purchasing the land back from the mortgage company.

To date no firm offer has been made, Underwood said.

Neither Dockins nor West could be reached for comment.
