Young case flip flops in court

ALEXANDRIA, La. — John Casey Young, a Ferriday resident arrested by the FBI Thursday for production of child pornography, remained in federal custody Monday after he was handed conflicting rulings by two federal judges.
Judge James Kirk dismissed the charge, which included one count of production of child pornography, early in the day, said Robert E. King, the supervisory senior resident agent with the FBI in Alexandria.
The U.S. Government, however, appealed Kirk’s decision and Judge Dee Drell overturned Kirk’s ruling later in the day, King said.
King said Young, 43, the director of Young’s Funeral Home, remains in the custody of U.S. Marshals in Alexandria, and Drell will preside over the case, King said.
King said Kirk originally dismissed the charges based on a motion filed by Young’s attorney during Monday’s preliminary hearing.
Young’s father, Leo, said he is assuming duties at the family funeral home as the acting general manager during his son’s absence, and Young’s Funeral Home remains fully operational.
According to Title 18 of the United States Code, Section 2251(a), a charge of production of child pornography pertains to those who encourage minors to engage in sexually explicit conduct for the purpose of visually depicting the conduct and transmitting the depiction in any way, including by computer.
Part (e) of Section 2251 states those who violate the code could be sentenced to not less than 15 years and no more than 30 years in prison.
